Discipline

The removal is resulting in 45-day placement in an alternative education setting by way of the ARD committee where weapons or drugs were part of the behavioral offense or by way of an impartial hearing officer who decided the behavior may continue to be dangerous to the student or others.

Therefore, a campus administrator and a special education teacher should determine and document what is needed in the AEP placement -

  • to allow the student to appropriately participate in the general curriculum
  • to allow the student to appropriately advance toward his or her IEP goals

Plus there should be documentation that services and modifications are provided and designed so that the precipitating offense does not recur.
