Code of Conduct/Quick Reference

Level IV Disciplinary Options


Any one or any combination of the following may be applied:

1. Any discipline technique outlined in Level III.

2. Citation by law enforcement personnel.

3. Alternative education placement. Other terms of removal will prohibit the student from attending or participating in school-sponsored or school-related activities.)

4. Reassignment of classes.

5. A student may be expelled if the student:

a. Continues to engage in serious or persistent misbehavior that violates the Student Code of Conduct or AEP classroom rules while the student is placed in an alternative education program for disciplinary reasons.

b. Engages in criminal mischief under Penal Code 28.03, if the conduct is punishable as a felony, whether committed on or off of school property or at a school-related activity, (intentional or knowing damage to school property resulting in a loss of $1,500 or more).

A student may also be expelled if the student commits any of the following acts while on school property or while attending a school sponsored or school related activity on or off the property:

c. Sells, gives or delivers to another person or possesses, uses, or is under the influence of:

1. Any amount of marijuana or a controlled substance in an amount not constituting a felony offense.

2. Any amount of a dangerous drug in an amount not constituting a felony offense.

d. Sells, gives or delivers to another person an alcoholic beverage; commits a serious act or offense while under the influence of alcohol; or possesses, uses, or is under the influence of alcohol, if punishment is less than that of a felony.

e. Engages in conduct that contains the elements of an offense relating to abusable glue or aerosol paint or relating to volatile chemicals.
